Terms and Conditions
These Terms govern the use of Traymo by landlords, tenants and service providers.
This translation is provided for information only. The German version is legally binding.
§ 1 Scope and provider
1.1 These Terms apply to the use of the Traymo platform (app and web, hereinafter "Traymo") operated by Marcel Traser, Rhönring 127, 64289 Darmstadt, Germany (hereinafter the "Provider").
1.2 Traymo is aimed at consumers and businesses. Landlords and tenants generally use Traymo as consumers; service providers (e.g. trade businesses) use Traymo as businesses (hereinafter "business users").
1.3 Deviating terms of users do not apply.
§ 2 Services
2.1 Traymo offers in particular: digital management of properties, tenancy agreements, documents and finances; communication between landlords, tenants and service providers; damage reports; a marketplace for trade services; AI-supported analyses.
2.2 The scope of services depends on the plan booked. The Provider may develop features further, provided the agreed core of the service is preserved.
2.3 Contract templates, calculators and AI analyses are aids. They do not replace individual legal, tax or financial advice.
2.4 Traymo is software. The Provider does not carry out property, rental or homeowners' association management for third parties (Section 34c of the German Trade Regulation Act, GewO). Each user makes and is responsible for their own statements and decisions towards tenants, landlords and service providers.
§ 3 Registration and account
3.1 Use requires registration with a valid email address and truthful information. Each person may only hold one account.
3.2 Login details must be kept secret. The Provider must be informed immediately if misuse is suspected.
3.3 The account can be deleted at any time in the profile settings (see Privacy Policy).
§ 4 Role of Traymo in the marketplace
4.1 Traymo acts solely as an intermediary. Contracts for trade or other services are concluded directly between the users (e.g. between a landlord and a trade business). The Provider does not become a party to the contract and owes neither the service nor its quality.
4.2 The respective contracting parties are solely responsible for offers, prices, appointments, performance, warranty and invoicing.
4.3 Business users are themselves responsible for holding the required qualifications and permits (e.g. registration in the register of craftsmen) and for meeting all statutory information obligations towards consumers (e.g. information on the right of withdrawal, prices including VAT).
§ 5 Tenders and requests
5.1 Landlords can put jobs out to tender. Before an offer is accepted, service providers only see the postcode and town, the released photos and the released description. The address and contact details only become visible once the job is awarded.
5.2 Service providers registered with Traymo receive requests from clients for tenders that match the services and location they have specified, as a message in the Traymo chat (where applicable with a push notification). Receiving such requests is part of the service. It can be switched off at any time in the company settings ("Receive requests from clients"); the company will then no longer be suggested for requests.
5.3 The Provider does not contact unregistered businesses – neither by email nor by text message or any other means, not even on behalf of landlords. Landlords can send them a request with a personal link themselves from their own email program, by text message or via the share function of their device, and adapt the prepared text beforehand. They are then the sender of the message and responsible for its lawfulness. Only requests relating to a specific job of their own are permitted; repeated or mass requests and advertising are prohibited.
§ 6 Ranking of search results
The order of service providers in search results is determined by the following main parameters (Article 5 of Regulation (EU) 2019/1150): match with the selected service category, distance to the job location and marking as a favourite by the searching user. There is no paid placement.
§ 7 User content, reviews and moderation
7.1 Users are responsible for the content they post (e.g. forum posts, chat messages, photos, reviews).
7.2 In particular, unlawful, insulting, discriminatory or misleading content, advertising unrelated to the use, content that infringes the rights of third parties, and photos showing identifiable persons or other people's property without authorisation are not permitted.
7.3 Content can be reported via the report function. The Provider reviews reports promptly and may remove inadmissible content, restrict its visibility or suspend accounts temporarily or permanently. Those affected receive a statement of reasons (Article 17 of Regulation (EU) 2022/2065) and can object to the decision by email to the point of contact named in the legal notice.
7.4 Reviews of service providers can only be submitted by the client side of a job completed via Traymo, up to 90 days after acceptance of the work. This ensures that reviews only come from customers who actually used the service (Section 5b(3) of the German Unfair Competition Act, UWG). The Provider does not publish purchased reviews and does not accept payment for the presentation of reviews. Businesses can reply to and report reviews, but cannot delete them.
§ 8 Further obligations of users
8.1 Users use Traymo only within the law and these Terms. In particular, entering false information, introducing harmful content, interfering with the security of the platform and automated reading of data are prohibited.
8.2 Anyone who enters personal data of third parties (e.g. landlords entering their tenants' data) must be entitled to do so and inform the data subjects in accordance with data protection law.
§ 9 AI-supported features
9.1 Traymo offers automated analyses (e.g. assessment of damage reports based on photos, contract analyses) and a chat assistant. They are based on artificial intelligence, are labelled as such and are non-binding guidance, not legal, tax or financial advice; they may contain errors.
9.2 The automatic damage analysis can be switched off in the Marketplace Settings. Use is subject to a quota per plan.
§ 10 Fees and subscriptions
10.1 Paid plans, their scope and their prices (including VAT) can be viewed in the app on the "Subscription" page.
10.2 Subscriptions are purchased and billed in the apps via Apple (App Store) or Google (Google Play); their payment, cancellation and refund terms apply in addition.
10.3 Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. A subscription is cancelled where it was purchased; the "Subscription" page shows where and takes you there via "Manage or cancel subscription". Deleting the Traymo account does not cancel a subscription.
10.4 Switching between plans is done via the existing subscription. When a subscription ends, the free Basic plan applies: existing data is retained; new entries beyond its limits are then not possible.
§ 11 Term, termination and suspension
11.1 The user agreement runs for an indefinite period. Users can end it at any time by deleting their account; an active subscription must be cancelled separately (§ 10.3).
11.2 The Provider may terminate the agreement with 30 days' notice; towards business users, the Provider states the reasons.
11.3 In the event of serious or repeated violations of these Terms or statutory provisions, the Provider may suspend accounts immediately or terminate the agreement without notice. The user concerned receives a statement of reasons and may respond.
§ 12 Data protection and processing on behalf
12.1 Information on the processing of personal data can be found in the Privacy Policy.
12.2 Where landlords process personal data of their tenants, co-residents or other persons in Traymo (e.g. tenant data, contracts, payments) or service providers record data of their customers (customer contacts, manually created jobs), they are controllers within the meaning of the GDPR. The Provider processes this data on their behalf in accordance with Article 28 GDPR. The provisions of the annex "Processing on behalf" at the end of these Terms apply.
§ 13 Availability
The Provider strives for high availability but does not owe uninterrupted accessibility. Maintenance work is announced where possible. A suitable device and an internet connection are required for use.
§ 14 Liability
14.1 The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
14.2 In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance users may regularly rely), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
14.3 The Provider is not liable for services agreed between users (§ 4).
§ 15 Intellectual property
All rights to Traymo (software, texts, design) belong to the Provider or its licensors. Users receive a simple, non-transferable right of use within the scope of these Terms. For their own content, users grant the Provider the rights required to operate the respective feature.
§ 16 Changes to these Terms
16.1 The Provider may amend these Terms with effect for the future if this is necessary for objective reasons (e.g. new features, changes in the law). Changes are communicated by email or in the app at least six weeks before they take effect; towards business users at least 15 days in advance.
16.2 Changes affecting essential rights and obligations (in particular the scope of services or prices) only take effect with express consent. For all other changes, users may terminate the agreement free of charge until the changes take effect; the notification will point this out.
§ 17 Complaints by business users
Business users can send complaints (e.g. about suspensions, restrictions or their presentation in search results) by email to kontakt@traymo.de. The Provider reviews complaints promptly and communicates the outcome.
§ 18 Final provisions
18.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence.
18.2 If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's place of business.
18.3 Should individual provisions be invalid, the remainder of the agreement remains valid; the statutory provisions apply.
18.4 The German version of these Terms is legally binding. Translations are provided for information.
Annex: Processing on behalf (Article 28 GDPR)
1. Subject matter and duration: The Provider processes personal data on behalf of landlords and – for their customer data – of service providers (controllers) in order to provide Traymo's management features for as long as the account exists.
2. Nature and purpose: storage, display, transmission to recipients designated by the controller (e.g. tenants, commissioned service providers) and analysis within the booked features, including document storage (filing, delivery to the parties involved, recording of approvals).
3. Data and data subjects: master, contact, contract, payment and communication data, photos and stored documents (e.g. contracts, statements, receipts, records) of tenants, co-residents, contact persons, service providers and customers of service providers. Copies of identity documents, credit reports and health data should not be stored.
4. Instructions: The Provider processes the data only on documented instructions from the controller; use of the app features constitutes an instruction. The Provider informs the controller if it considers an instruction to be unlawful.
5. Confidentiality and security: Staff are bound to confidentiality. The Provider takes appropriate technical and organisational measures (including access restricted to authorised persons, encrypted transmission, storage in the EU).
6. Sub-processors: Google Cloud / Firebase (Google Ireland Ltd., data centres in the EU), Google Vertex AI (EU region) and, for sending emails, STRATO GmbH (Berlin). The controller is informed in advance of new sub-processors and may object.
7. Assistance: The Provider assists the controller with data subject requests, the notification of personal data breaches and data protection impact assessments, and reports breaches without undue delay.
8. Deletion: When the account is deleted (end of contract), the data is deleted unless there is a statutory retention obligation. Beforehand, the controller can export their data in the app (Edit Profile → Delete account → Export data). Tenants with a Traymo account receive copies of their own tenancy documents (contracts, statements, handover reports). Documents already delivered to the parties involved remain as their copy. Statutory retention obligations for receipts remain the responsibility of the controller; Traymo offers a download of all documents as a ZIP file for this purpose.
9. Evidence and audits: The Provider makes available the information necessary to demonstrate compliance and allows audits after prior agreement.
